It may involve simple bribery of judges and court officials, or it may involve interference with the judicial system for political reasons of a much more insidious kind. Unjust convictions may result, just to keep the system going and keep prices up. Everyone whose case comes before the courts of that country where practices of that kind are widespread is at risk of suffering an injustice. Those who are familiar with the system may know how much they need to pay, or what they have to do, to obtain a favourable decision but be quite unable  to come up with what is  needed to achieve that. Those who are not familiar with it will be at an even greater disadvantage...The stark fact is that systemic corruption in a judicial system affects everyone who is subjected to it. No tribunal that operates within it can be relied upon to be independent and impartial. It is impossible to say that any individual who is returned to such a system will receive that most fundamental of all the rights provided for by article 6 of the Convention, which is the right to a fair trial.

The need for judicial reform is dire. Judges have NO incentive to learn the tools of their trade — because they cannot be held accountable for wrongdoing, for not properly carrying out their job even if the wrongdoing is KNOWING or even of it is a result of NEGLIGENCE. As a result, judges decide whatever they want according to their whim. In the best case they have good intentions but are ignorant–they don’t know or understand the laws, and they don’t know or understand the facts (because they don’t have backgrounds in mental health and can’t understand that one party may in fact be mentally ill, that one party may in fact be at fault while the other is a victim. They foolishly believe it takes two to tango–not understanding that when mental illness is involved, the victim has done nothing other than marry the wrong person (often unknowingly) and in any event, the perpetrator should never ever be allowed to be abusive (physically or emotionally)–that’s a choice the perpetrator makes and it’s wrong. With no appropriate skills to make the right decisions, things go awry. That’s the best case. The worst case is judges taking bribes (and if you don’t believe it, google judge Blakely) and judges acting out their biases, jealousies or childhood issues. And they can — they have the power of the gavel to issue any order they want, even if the order is illegal–because if someone doesn’t follow the order, they risk that judge punishing them–putting them in jail, ruining their career, ordering their assets liquidated…

Why local,state, and federal law enforcement does not prosecute elder abuse by lawyers ?

It appears due to the baby boom now coming of age and the federal government concerned with entitlements the elderly and there families will finally have some attention, states all over this country have had many years with redistributing the assets of the innocent all played out in probate and family court promoted with the legislature providing the tools endorsed and facilitated by the bar association and there army of lawyers and others, critical thinking is in order relative to the tools provided to guardians, conservators, receivers, power of attorney, restraining orders etc for what seem feels and appears might not be the truth?
